Terms of Service — MyDay Start
These terms cover your use of MyDay Start, provided by JAR Tech LLC. Using MyDay Start means you accept them.
Who may use MyDay Start
MyDay Start accounts are intended for people 18 years of age or older. We do not knowingly collect personal information from anyone under 18. MyDay Start does not currently ask for or verify a date of birth, so this is a condition of use rather than something the product enforces — we would rather say that plainly than imply a check that does not exist. If we learn that an account belongs to someone under 18, we will close it and delete the information associated with it.
You are responsible for what happens under your account, and for keeping your sign-in details to yourself.
Cost
Creating a MyDay Start account is free. That does not mean every future function, service, membership or commercial offering will necessarily be free. If MyDay Start later introduces paid membership, higher usage tiers or other paid benefits, they will be presented separately, with the benefit, the price and the decision made clear before any purchase — never afterwards. Free account creation is not a way into a paid plan, and introducing one later will not change the fact that creating a basic account is free. There is nothing to buy in MyDay Start today, so these terms carry no billing, renewal or refund provisions; they will be added, and made visible, before anything is sold.
Your content
What you write and store in MyDay Start remains yours. You give us permission to store, process and display it for the purpose of providing the service to you, and for nothing else. We do not claim ownership of it and we do not sell it.
You can ask for a copy of it, or ask us to delete it, at any time. The privacy policy explains how.
Acceptable use
Do not use MyDay Start to break the law, to harm or harass another person, to interfere with the service or its security, to gain access to accounts or data that are not yours, or to scrape or resell the service.
Commercial recommendations
MyDay Start may show commercial recommendations. MyDay Start may be supported partly through collaborative, commercial or affiliate arrangements. Our affiliate and commercial disclosure explains when and how.
A recommendation is not advice, an endorsement, or a promise about a third party’s product, price, availability or conduct. If you choose one, you leave MyDay Start and the other company’s terms govern what happens next — including payment, delivery, support and refunds. Your dealings with them are between you and them.
Availability
We work to keep MyDay Start available, but we do not guarantee uninterrupted service. Features may change, and parts of the product may be added, altered or withdrawn as it develops.
Ending the relationship
You can close your account at any time, and take a copy of your information with you. We may suspend or close an account for abuse, unlawful use, or to protect the security of the service or other people using it. Where circumstances allow, we will tell you why.
Disclaimer
MyDay Start is provided as it is. To the fullest extent the law allows, we make no warranties of any kind about it, express or implied, including any implied warranties of merchantability, fitness for a particular purpose or non-infringement. MyDay Start is a planning and continuity tool. It is not medical, legal, financial or professional advice, and should not be relied on as any of those.
Limitation of liability
To the fullest extent the law allows, JAR Tech LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of MyDay Start. Some jurisdictions do not allow these limits, in which case they apply to you only as far as the law permits.
Changes to these terms
We may update these terms as the product develops. If a change is material, we will make it visible rather than only changing this page quietly. Continuing to use MyDay Start after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of the Commonwealth of Puerto Rico, without regard to its conflict-of-law rules. JAR TECH LLC is constituted in Puerto Rico.
Disputes
If a dispute arises, we would rather hear from you first — most things are resolved by email. If it cannot be resolved that way, disputes are heard by the courts of applicable jurisdiction in Puerto Rico, and both sides agree to that venue. There is no mandatory arbitration clause in these terms.
